Mental Capacity Act 2005 and Deprivation of Liberty Safeguards
The MCA/DoLS committee works to deliver the Mental Health Capacity Act 2005 and the Deprivation of Liberty Safeguards (DoLS) supporting people who have lost their capacity to make decisions either temporarily or longer term.
The Mental Capacity Act 2005 provides a statutory framework for acting and making decisions on behalf of individuals who lack the mental capacity to do so for themselves. It introduced a number of laws to protect these individuals and ensure that they are given every chance to make decisions for themselves. The Act came into force in October 2007.
The Deprivation of Liberty Safeguards (DoLS) is a provision within the MCA 2005. DoLS came into force on 1st April 2009. The safeguards provide a legal framework for Local Authorities and Primary Care Trusts to authorise the deprivation of a person's liberty if it is deemed to be in their best interests.
